TERMS AND CONDITIONS OF PURCHASE

 To place an order on the Multiópticas online store, you must first accept the following terms and conditions:

1. IDENTIFICATION.

The General Conditions of Contract included in the present document apply to all commercial transactions conducted through the website WWW.MULTIOPTICAS.COM, owned by MULTIÓPTICAS, S.C.L., (hereafter MULTIÓPTICAS) with tax code F28465193 and located at Avda. de los Reyes, s/n P.I. La Mina, 28770 Colmenar Viejo (province of Madrid).

For the purposes of this document, the contact telephone number is (+34) 918 357 302 and the contact e-mail address is atencioncliente@multiopticas.com.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY.

The rights related to industrial and intellectual property, including, but not limited to: brands, trademarks, text, photographs, icons, images, etc., in addition to the graphic design, source code and other software elements contained in the website WWW.MULTIOPTICAS.COM, are the property of MULTIÓPTICAS or of the distributors and manufacturers of the products offered. They are therefore subject to the intellectual and industrial property rights protected by Spanish and international legislation.

Without prior verifiable written authorisation from MULTIÓPTICAS or, where appropriate, from the distributor or manufacturer of the product subject to the property rights, it is prohibited to use, reproduce, transmit, manipulate, or perform any actions in excess of normal and necessary usage of the website and the services it offers.

Access to the products supplied does not imply that MULTIÓPTICAS foregoes, transfers or cedes, either totally or partially, intellectual and industrial property rights, nor does it assign rights of use, alteration, exploitation, reproduction, distribution or public communication of these contents without prior and express written authorisation from the respective holders of said rights, without prejudice to the right to view and obtain private and secure copies of said contents, provided that said right is exercised in accordance with the principles of good faith and that the intellectual and industrial property of the owner of said rights remains unaltered and that use is not for commercial purposes, but exclusively for the user’s personal information.

The responsibility for the use of materials protected by the intellectual and industrial property rights contained on this page corresponds exclusively to the user.

3. OBJECT AND ACTIVITY.

MULTIÓPTICAS, through its website WWW.MULTIOPTICAS.COM, is dedicated to the sale and distribution of optical products: glasses, contact lenses, etc.

4. UPDATE OF THE WEBSITE IN REFERENCE TO CONTRACTING.

MULTIÓPTICAS reserves the right to make modifications to and to update products, prices, promotions and any other conditions contained at WWW.MULTIOPTICAS.COM

MULTIÓPTICAS, within its means, endeavours to ensure that the information provided on its website is accurate and appears without typing errors. Should there be any typing error, beyond our control, it will be immediately corrected. If any customer should have made a purchase on the basis of an error of this kind, we will inform them immediately of said error, with both parties being able to terminate the purchase with no cost incurred, provided that the existence of said error is justified.

5. LANGUAGE AND LENGTH OF CONTRACT. MINIMUM AGE FOR CONTRACTING

Regardless of any potential translations of these conditions of sale, the official language for the contract will always prevail: Spanish.

In terms of the length of the contract, we refer to all the phases between the initial order request to the actual delivery of the goods by MULTIÓPTICAS and payment in full by the customer.

In accordance with art. 1263 of the Spanish Civil Code, neither non-emancipated minors nor legally incapacitated individuals may enter into long-distance purchase or sales contracts without the express consent of their parents or guardians.

By accepting these general conditions of sale, the Customer declares that they are of legal age (at least 18 years old) and have the legal capacity to procure services and/or products offered through WWW.MULTIOPTICAS.COM and that they understand the general conditions in their entirety.

6. LEGAL GUARANTEE AND AFTER-SALES SERVICE.

In their capacity as a consumer, the customer of our online store has, aside from the rights described here, all the legal rights as defined by Spanish and European legislation regarding the sale of consumer goods. It should be noted that said legal rights can never be affected by these ‘general conditions of sale’.

In the case of a defective product, it should be noted that, in accordance with the current regulations, the seller should, as applicable, arrange repair, replacement, price reduction or termination of contract, and such measures will incur no cost to the consumer and user. The seller is responsible for any non-conformity that may manifest itself within a period of two years from the delivery. The consumer and user must inform the seller of the non-conformity within two months of becoming aware of it. Get in touch with our customer service team to do so.

7. ACCURACY OF PRODUCT DESCRIPTION

We are committed to maximising the accuracy of all information regarding the characteristics, qualities, images, etc. of products listed in our online store. However, we cannot guarantee that there won’t be occasional differences due to the settings of the various internet browsers used to access our online store.

Should the customer believe that the product they have purchased does not correspond fully to the product displayed in our online store, they may return it in accordance with the manner and time periods described here (see the “Returns” section), without the right to make any other claim for damages of any kind

8. HOW TO BUY

  1. Find your products:

Find the product you want in the corresponding section. You will be able to see the full product description and price on the product page.

  • With mó sunglasses you will be able to choose your preferred colour.
  • In the case of contact lenses you will need to fill in the fields related to your prescription. If you need assistance, or more information related to the field you need to fill in, click on “help” or hover the cursor over the section that you are unsure about. Read the instructions carefully and make sure that the information and prescription that you enter is correct.

To add the product to your shopping cart, you will need to click on the “buy” button.

  1. Review your cart:
  • Once you have added all the products you want to buy to your shopping cart, click on it to begin the purchasing process. You will then see a summary of the products selected, with the quantity and unit price, along with taxes included, delivery charges and a total order value. You can amend the contents of your order, by removing products that you no longer want to buy, or adding more units of the products you have already selected.
  • If you have a promo code, enter it here as the corresponding field.
  • Once you are finished, click on the “continue” button.
  1. Login/Sign up:

You have several options:

If you are a registered user, you just need to login with your username and password to continue with your order.

If you are not registered, you have three options:

  • Sign up by completing the relevant fields. We recommend you do this so you are able to track your order at all times, gain access to exclusive benefits and place orders much more quickly in the future.
  • Place your order as a guest. In this case, you will only need to provide us with the information that we need to process and deliver your order.
  • Login with your Facebook or Google/Gmail username and password. You will only need to provide us with the information that we need to process and deliver your order.
  1. Complete your order:
  • Delivery: You can choose between:
    • Delivery to a specific address: You will need to give us the details we need in order to deliver your order, including all information related to the delivery address and your contact information, so that the courier service can find you.
    • Collection in store: You will need to select the store where you would like to collect your order, and give us your contact details so that we can let you know once it is ready to be collected, or if any problem should arise. Not available for Ceuta or Melilla
  • Payment: You can pay by card or with PayPal. You will need to select your preferred payment method and fill in the corresponding information.
  • Complete your purchase: Before you complete your purchase, check all the information to make sure it is correct. Confirm that you agree to the conditions of purchase by clicking the corresponding box and complete your purchase.

9. PAYMENT METHODS.

We accept the following payment methods: Credit and debit cards and Paypal.

 

10. TRANSACTION SECURITY.

WWW.MULTIOPTICAS.COM employs industry-standard information security techniques, such as firewalls, access control systems and cryptographic mechanisms, all with the aim of preventing unauthorised access to information. To this end, the user/customer accepts that the provider will gather data for the purposes of the corresponding authentication for the access control systems.

All contracting processes that involve entering personal information will always be transmitted via secure communication protocols (HTTPS://) to prevent any third party from accessing the information transmitted electronically.

 (*) For deliveries to Ceuta and Melilla, the User will need to pay the customs charges and taxes, applicable to the order. These charges need to be settled once the order is delivered, and will never be included in the price that is paid for the products. Should the order not be received due to reasons attributable to the customer, all costs associated with its subsequent delivery or return will be the responsibility of the customer.

MULTIÓPTICAS undertakes to deliver goods purchased by the customer, to the address indicated on the order form. Should said information not be entered, or be entered incorrectly, MULTIÓPTICAS shall not be held responsible for any inconvenience caused or redelivery costs incurred on behalf of the customer. We are not able to deliver to P.O boxes or pay phone centres.

The customer may also request that their order be “delivered to a store”. A preferred delivery point may be chosen during the purchasing process from a list of the MULTIÓPTICAS stores associated with our online sales program.

Deliveries will only be made to Spanish territory, through the use of a courier company. MULTIÓPTICAS reserves the right to vary the method of shipment and the company which is used to carry it out, irrespective of that stated on this website and provided that this is not detrimental to the customer.

We accept full responsibility for the items until delivery to the customer is complete.

Should we be unable to deliver the order within the established time period on the grounds of force majeure, MULTIÓPTICAS is committed to informing the customer of the new estimated delivery date as soon as possible.

If the courier company is unable to complete the delivery because there is no-one available to receive it at the indicated destination, the courier company itself will provide instructions to the customer to arrange a new delivery date. All transport costs incurred if the delivery fails for reasons that cannot be attributed either to Multiópticas or to the transport company will be covered by the customer.

At the point of delivery, the customer should check that the goods received match the quantity and product type that they ordered. If there is any discrepancy, the customer should follow the instructions in section 12 of the present Conditions.

MULTIÓPTICAS will inform the customer of all delivery costs. By accepting the “general conditions of sale”, the customer assumes responsibility of the delivery costs that are attributable to them. There will be no delivery costs for orders over 40 euros. 

12. RETURNS.

Returns due to damaged, defective or incorrect products

Should the products arrive damaged or defective, or they do not correspond to the order that was placed, Multiópticas is committed to exchanging them at no extra cost with an replacement or with the correct product, provided it is in stock. Should this not be possible, we will refund the value of the product and, if applicable, all costs related to its delivery and return. In order to request such a return, you should get in touch with our customer service team within a maximum of 3 working days from receipt of the order. Once this time period has passed, we will be unable to exchange any defective, damaged or incorrect products. Our customer service team will let you know how to proceed.

Right to Return Goods

If for any reason you are not satisfied with your order, please note that undercurrent regulations you have a period of 14 calendar days, beginning on the date of delivery of the product, in which to return it. However, Multiópticas has extended this period for our customers to exercise their right to return goods to 30 calendar days, for orders placed on www.multiopticas.com. In order to exercise your right to return goods you have purchased, all products to be returned must be in perfect condition and in their original packaging.

Please note that all personalised items are strictly excluded from the customer’s right to return purchased goods.

Please note that should you exercise your right to return goods, all delivery costs related to the return will be your responsibility. Multiópticas will refund the value of the order and all delivery costs, should there be any. If you are sending goods from Ceuta or Melilla, you will need to send the products using a transport company of your choosing, and pay the customs charges.

It is essential that you include a copy of the returns request document inside the package along with the returned products, which should include the order number and up-to-date contact information, so we can contact you once the returned goods have been received at our warehouse.

The returns procedure previously mentioned is the only accepted means of returning goods, and no returns will be accepted via our network of Multiópticas stores.

Refund
The refund period is 14 calendar days from the request to return, although this will only take effect once the items have been received and inspected to ensure that the user has not manipulated them in any way, aside from what was required, and to check the condition and proper functioning of the items.

The refund will be made using the same payment method used to place the order.

13. DATA PROTECTION

Overview. In compliance with the current Data Protection Regulations, we inform you that your personal information will be processed by MULTIÓPTICAS, who will be responsible for processing it for the purposes of administrative, tax and accounting management for orders placed with our online store, in addition to carrying out promotional activities and sending commercial information relating to our products.

Furthermore, it should be noted that your information may be disclosed to courier or transport companies, in order to fulfil the objectives for which you provided us with that information.

Please note that, except by express consent of the interested party or in cases of legal obligation, MULTIÓPTICAS will not share your personal information with any third party, aside from those mentioned here where appropriate.

You have the right to obtain information on how MULTIÓPTICAS processes your personal data, and also the right to access that data, rectify inaccurate data or request deletion when the data are no longer necessary, in addition to exercising all other rights established by the regulations, as explained in the additional information. Legal authority for the use of customer e-mail addresses. Due to signing up on our website and purchasing our products, customers will receive e-mail promotions as well as newsletters containing information about new products. This service conforms to article 21.2 of the Law 34/2002, on Information Society Services and Electronic Commerce, modified by the General Telecommunications Law 32/2003, of 3 November, that authorises the sending of commercial communication by electronic means when there already exists a contractual relationship and when the products or services being advertised are similar to those supplied through the contract. However, all commercial communication sent by MULTIÓPTICAS will be clearly identifiable as such by the use of the term “publicity” at the beginning of the body of the e-mail, and MULTIÓPTICAS, S.C.L. will be identified as the entity that has sent the e-mail. Each communication will provide a simple and free-of-charge means for the recipient to unsubscribe from our commercial communications database.

14. APPLICABLE LEGISLATION

All commercial transactions made with WWW.MULTIOPTICAS.COM are subject to Spanish legislation.

  • The Law 7/2017, of 2 November, which incorporates into Spanish law the Directive 2013/11/UE of the European Parliament and Council, of 21 May 2013, concerning the alternative resolution of consumer disputes.
  • Law 3/2014, of 27 March, which modifies the consolidated text on the General Law for the Protection of Consumers and Users and other complementary laws, approved by the Royal Legislative Decree 1/2007, of 16 November.
  • EU Regulation nº 524/2013 of the European Parliament and Council of Europe, of 21 May 2013
  • Royal Legislative Decree 1/2007, of 16 November, which approves the consolidated text on the General Law for the Protection of Consumers and Users and other complementary laws.
  • Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, and the General Telecommunications Law 32/2003, of 3 November.

Should there be any conflict or disagreement in the interpretation or application of these General Conditions of Contract, the Courts that are hearing the case will determine the applicable regulations with regard to jurisdiction.

Should the buyer be based outside Spain, both parties will be subject to the Courts of Madrid (Spain).

15. OBLIGATION FOR BUSINESSES TO PROVIDE INFORMATION ABOUT ACCREDITED ENTITIES FOR THE ALTERNATIVE RESOLUTION OF CONSUMER DISPUTES (art. 40, Law 7/2017, dated 2 November)

In compliance with Art. 14.1 of EU Regulation 524/2013, the European Commission provides an online platform for the resolution of disputes that can be used should there be any discrepancy, conflict, etc. between the consumer and our business. 16. ELECTRONIC INVOICING

By accepting these general conditions of sale, the customer gives their consent for MULTIÓPTICAS, S.C.L. to issue them with any invoices generated by transactions made through the use of our website, in accordance with Spanish regulations for Electronic Invoicing.
